This is an appeal by defendant from a conviction for violating Section 338.010, RSMo 1959, V.A.M.S., which makes it unlawful
for one not a licensed pharmacist to dispense or sell drugs prescribed by a physician. Defendant was represented in the trial
by counsel of his own choice but he has filed no brief in this court, and in that situation we will review all assignments
of error properly raised in defendant's motion for a new trial and those matters specified in Supreme Court Rules 28.02 and
